IBOA Position on the ICTU Day of Action: March 30, 2009

For workers in the private sector, the Day of Action planned by the Irish Congress of Trade Unions is intended as a response to employers who have refused to honour the terms of the recent negotiated pay terms of the national agreement, Towards 2016.
Under that agreement, enterprises which are experiencing commercial difficulties may plead inability to pay. If they do, the claim is to be subject to investigation by a third party with a view to making a determination as to its validity.
Some of the employments where the IBOA is organised have already agreed to pay the first phase increase due under the national agreement. Others have indicated that they may have some difficulty - but have nevertheless indicated that they are prepared to engage in negotiations with the Union and, if necessary, to refer any issues of disagreement for investigation by a third party with a view to making a determination.
Under these circumstances, since the issue at the heart of the proposed Day of Action has either been settled or is in the process of negotiation as far as our members are concerned, the Executive Committee of IBOA has decided that there are no grounds at this stage for balloting any of our members on the issue of industrial action.
In the event of a serious breakdown in any of the talks currently ongoing with various employers, the Executive Committee would have to consider what action would be necessary at that time.
