N.O.R.M.A. Project
New Operating Industrial Relation to Manage Antidiscrimination
Recent EU Directives have extended the anti-discriminatory safeguards in favour of workers and proposed a new regulation method. This process consists of an increased protection and its extension to new "high-risk" categories, in the form of a mainstreaming intervention that tends to counter the possible discriminatory impact of measures that concern the job market overall.
It is necessary to verify the extent to which new measures aimed at making the job market more flexible are coherent with the anti-discriminatory strategy or they produce inequalities.
The following Unions has participated to project's activities: IBOA The Finance Union, ETYK, FeS/UGT, Fiba/CISL, Finansforbundet, FTUFS, INE-OTOE, UNI Global Union, UNITE, Ver.di.
The research conducted is one of the first experiences in the banking sector, in the environment of the new EU and national legal framework.
The present action intends to study in detail the actual Social Dialogue on anti-discrimination policies in Banking sector, funding on the work developed by representatives of the social parties themselves.
All the data coming from each partner Country, was discussed in the course of a two day meeting, with the aim of outlining the guidelines for trade Unions and employers' negotiators in order to share the knowledge of significant experiences within the individual countries and provide practical instructions to prevent or eliminate potentially discriminatory contents which may be hidden within the general contracts without the knowledge of the parties, in light of the principles and innovative measures foreseen by the European directives (see "legal framework" for complete texts).
During the following workshop; a debate between the Union representatives, and the employer Partner Banca Popolare di Milano, with the participation of involved employers' HR and bargaining structures, with the aim of improve the introduction of anti-discriminatory legislation into social dialogue, with reference to good practices models.
In a second phase of the workshop the guidelines defined during the planned activities, was shared through a debate between the parties, during which the dialogue was simulated on the basis of the guidelines and principles of the measures contained in the mentioned European directives.
The final steering lines, in addition to the description of the relevant legal and contractual framework, and the processing of the results of the study, identifies useful indications for establishing discrimination-aware consultation and negotiation practices that can identify promotional measures of Social Dialogue in the banking sector.
